Galaxy Tab 10.1 injunction upheld In Germany!

The Düsseldorf Regional Court has upheld the preliminary injunction against the Galaxy Tab 10.1 based on Apple's claims of infringement of a Community design IP rights held by Apple. Even this ruling of the injunction is limited to Galaxy Tab 10.1 sales in Germany and the German subsidiary is barred from selling across the border. So the Apple vs Samsung continues in a new gait.

The same court had granted Apple a EU-wide injunction on August 9, except for the Netherlands and then suspended that injunction on Galaxy Tab and limited the scope to ermany. Today the court affirmed the decision to upheld.

Also there are possible steps that Samsung could take to remedy the current situation like taking the case to a higher court in Germany like Oberlandesgericht Düsseldorf (Higher Regional Court) and try to seek a fast way out of the injunction.
