Motorola - Microsoft Patent Case Before ITC Today!

Microsoft’s patent case against Motorola Mobility began today in front of the International Trade Commission in Washington and according to media reports, the battle is set to get ugly,



Microsoft is accusing Motorola Mobility of infringing seven of Microsoft patents, is demanding an injunction from the ITC to stop some Motorola’s phones from being imported into USA. “Microsoft is one of the world’s most innovative companies and we have a responsibility to our employees, customers, partners and shareholders to safeguard our intellectual property, Motorola is infringing our patents and we are confident that the ITC will rule in our favor." said ” David Howard, deputy general counsel for litigation at Microsoft, in a statement to AllThingsD.



Motorola and the new intended suitor, Google will not be happy if ITC to that. Google offered 12.5 Billion to Motorola Mobile and was intending to protect Android OS and Android based phones from bullies in arms like Microsoft, Apple and RIM.

Motorola sees sagging Microsoft's attack as it's new business strategy and promises to do everything to to protect Motorola Mobility and how;



“We are vigorously defending ourselves against Microsoft’s patent attack business strategy, We have also brought legal actions of our own in the U.S. and in Europe to address Microsoft’s large scale of infringement of Motorola Mobility’s patents.” ” Motorola said in a statement.



For all it's goodness and Microsoft's need to make it's lawyers rich, it looks like will end up in a licensing deal, so Microsoft can continue to make those not so popular windows Phones.

Apple Being Sued For Patent Infringement In Fast Booting of Mac OS X.!

Operating Systems Solutions, LCC, has filed a patent infringement lawsuit against Apple for OS X's fast booting operation.

Patently Apple, site celebrating Apple's inventions thinks this a work of patent troll and that LG Electronics is involved some where in the equation.

Looking at the patent, it looks like a legitimate patent and does not seem to be like many Broad patents that are in the play now in the mobile arena. Except for the fact that Operating Systems Solutions, LCC, does not make laptops or computers that use the patent technology, I do not see any similarity to the likes of Lodsys or Macrosolve.

FOSS Patents has a much better review of the fact and thinks it is a precursor to a wider patent war between Apple and LG.

I do not believe in ridiculous patents, that includes some of Apples but I think it is need to be watched as over all, innovation or simple app developments have been thwarted by stupid patents.

Apple should also know when it tries to clamp down on competitors, someone somewhere will use the same sword on Apple. So Apple use that 70 Billion and start buying some more patents, like

Samsung Answers To Apple's Amended Complaint, & Says Apple Can't Take On Competition!

Apple has replied to Apple's amended complaint and also has dropped a separate counter claim suite to be incorporated in to the main law suite.
Samsung denies Apple's claims of copying and scoffs at apple for not being able to be a fair player and take on the competition.
"The Samsung Defendants admit that they have not ceased competing with Apple notwithstanding Apple's efforts to avoid such competition."
Samsung is also saying that they do invest in research and development and they have a quite a few patents to show for it.
So they added some of those patents in their answer it seems:
  • U.S. Patent No, 7,079,871 on a "portable telephone and method of displaying data thereof"

  • U.S. Patent No. 7,456,893 on a "method of controlling digital image processing apparatus for efficient reproduction and digital image processing apparatus using the method"

  • U.S. Patent No. 7,577,460 on a "portable composite communication terminal for transmitting/receiving and images, and operation method and communication system thereof"

  • U.S. Patent No. 7,698,711 on a "multi-tasking apparatus and method in portable terminal"

Samsung Files A Complaint Against Apple With ITC.

Yesterday Samsung has filed a complaint with ITC against Apple regarding some of its products, mostly covering mobile products. The complaint no. 337-2824 indicates following types of products:
Letter to James R. Holbein, Secretary, USITC, requesting that the Commission conduct an investigation under section 337 of the Tariff Act of 1930, as amended regarding Certain Mobile Electronic Devices, Including Wireless Communication Devices, Portable Music and Data Processing Devices, and Tablet Computer . The proposed respondent is Apple Inc., Cupertino, California.

Apple and Samsung used to be cozy industrial partners with Samsung providing chips and chipsets for most of the Apple products. But the relationship soured after Apple went against Samsung, and claimed in a U.S. lawsuit that Samsung’s Galaxy phone and tablet computers “slavishly” copy the iPhone and iPad. Just after Apple lost against Nokia.
Samsung is claiming 5 patents in the dispute and seek to block import of iPhone and iPads in to USA.

Did Verizon Pay $350 Million To Patent Lenders, Intellectual Ventures To Fight TiVo?

The Law.com is reporting that Verizon worked with a large and secretive patent collecting horde known as Intellectual Ventures to play cards against Tivo. Tivo sued Verizon earlier for infringing one of it's patents.
Verizon Communications has agreed to pay Intellectual Ventures (IV) as much as $350 million for the deal.(The $350 million Verizon deal was first reported by the Wall Street Journal in 2008. Merino confirmed on Thursday that Verizon is a member of IV.)
I think we are set to see a patent war (Techdirt has a collection to show it), You can add Intellectual Ventures as an arms dealer in this war. IV is employing patent trolls to launch and fight it's lawsuits, according to the law.com
My next phone will not come from Verizon. You too can protest about this patent war, choice is yours.
